Welcome to 茶洽 ("Cha Cha"). These Terms & Conditions (“Terms”) govern your use of our website www.chachadesserts.com, our membership program, and our services.
By accessing our site or registering as a member, you agree to be bound by these Terms.

Membership Program
Eligibility: Membership is open to individuals aged 18 and above. Minors must obtain parental consent.
Verification: We reserve the right to request a valid Malaysian Identity Card ("IC") or Passport to verify birthday rewards or account ownership.
Account Security: You are responsible for maintaining the confidentiality of your mobile number / account. Any redemptions made via your account are deemed authorised by you.
Redemption: Birthday rewards are issued once per calendar year.
Promotions, Vouchers & Discounts
No Stacking: Unless explicitly stated, promotions, vouchers, and member discounts cannot be combined or "stacked" in a single transaction.
Higher Value Rule: If multiple discounts apply, the system will default to the single highest discount available to the customer.
Modification: Cha Cha reserves the right to withdraw or amend any promotion at any time without prior notice due to stock unavailability or technical errors.
Exclusions: Promotions do not apply to retail merchandise, bottled tea, or bulk office orders unless specifically mentioned.
Online Orders, Delivery & Refunds
Accuracy: You are responsible for ensuring the delivery address and contact details are correct.
Rectification of Errors: In accordance with CPETTR 2024, you may contact us immediately at +6011-5504 3096 to rectify any order errors before preparation begins.
Quality Guarantee: We strive to ensure your Bingsu and Gelato arrive in optimal condition. If an item is defective or materially different from your order:-
You must notify us within 30 minutes of receipt with photographic proof.
Cha Cha will bear the cost of re-delivery OR provide a full refund for the affected item.
Perishable Goods: Due to the nature of our products (frozen desserts), we do not accept returns for change-of-mind.
Food Safety & Allergies
Allergen Notice: Our products are prepared in an environment that handles dairy, nuts, gluten, and soy. While we take every precaution, we cannot guarantee a 100% allergen-free environment.
Customer Responsibility: Customers with severe allergies are advised to consult our staff or refrain from consumption. Cha Cha is not liable for adverse reactions from undisclosed sensitivities.
Privacy & Personal Data ("PDPA")
Your personal data (Name, Mobile, Birthday) is processed according to our [ Privacy Policy ]. Under the PDPA (Amendment) Act 2024:-
We notify the Commissioner of any data breach within 72 hours.
You have the right to Data Portability (requesting your data in a digital format).
We do not sell your data to third parties.
Intellectual Property
All content on this website, including the "茶洽" logo, food photography, and brand descriptions, is the property of Orbitous F&B Sdn Bhd. Unauthorised use or reproduction is strictly prohibited.
Limitation of Liability
To the fullest extent permitted by Malaysian law, Cha Cha shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or membership program. Our maximum liability for any claim is limited to the amount paid by you for the specific transaction in question.
Right to Amend
We reserve the right to amend these Terms & Conditions, including reward structures and point values, at any time without prior notice. Continued use of the membership constitutes acceptance of the new terms.
Governing Law
These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the Malaysian courts or the Tribunal for Consumer Claims Malaysia ("TTPM").
